Fourballer Terms of Use
Effective date: 3 October 2026
These terms are an agreement between you and Bruce Watermeyer and Patrick Kerr, who run Fourballer ("we", "us"). By using Fourballer you agree to them and to our Privacy Policy.
1. What Fourballer is
Fourballer helps golf groups organise rounds, keep score, apply handicaps and work out each player's result for the games the group chooses to play. Fourballer only keeps records. It never holds, sends or receives money. It sets no values: any amount attached to a game is agreed by the players themselves. And it takes no part in any arrangement between players. "Mark as settled" records that a group considers a round square; it doesn't move money.
2. Your arrangements are your own
Any arrangement between players, including amounts agreed for a game and paying or collecting them, is between those players. You're responsible for making sure anything you arrange is lawful where you play. We're not a party to it and don't guarantee that anyone pays. Any amount the app shows is only a calculation from your group's own inputs (see section 6).
3. Who can use it
You must be 18 or older, and able to form a binding contract. You need a compatible phone and an email address (or, where we offer it, an Apple or Google account) to sign in.
4. Your account
Keep your phone and sign-in secure; you're responsible for what happens in your account. Give accurate details, and only add other people (to a group, a round, or as a guest) if they'd reasonably expect it. You can delete your account at any time (see the Privacy Policy).
5. Using it fairly
Don't use Fourballer to break the law; harass, impersonate or mislead anyone; enter information you've no right to share; interfere with the service or other people's use of it; or copy, resell or reverse-engineer the app. We may suspend or close an account that does.
6. Scores and results: a record of your inputs, not an official scorecard
Fourballer is a note-taking tool. Everything it shows (scores, handicap strokes, game results, standings and who owes whom) is worked out only from what players type in and the settings the group chooses. It records your play; it doesn't watch it. We don't monitor, check or verify what players enter, and it's your responsibility to judge whether the scores and results are accurate and complete.
- It isn't an official scorecard. Keep a traditional scorecard, or another record your group trusts, for every round. Where the app and your scorecard disagree, your scorecard and your group's agreement decide, not the app.
- Check it together before you settle. Players should compare scores hole by hole and agree the results between themselves before anyone marks the round as settled. Once it's marked settled, its results are final in the app.
- Record your scores as the Rules of Handicapping require. Enter each score honestly and in line with the USGA Rules of Handicapping and your own responsibilities as a player under them. That duty stays with you when you use Fourballer.
- Anyone in a round can enter or change scores. When two phones disagree, the change that reaches us last is the one kept. Every change is recorded, but the app can't tell which entry is right.
- Errors can happen. A wrong input, a setting chosen by mistake, a lost connection or a fault in the app can all produce a wrong result. We work hard to get the calculations right, but we don't promise they're free of errors, and we aren't responsible for decisions or arrangements players make based on them.
7. Your content, and connected services
"Your content" means what you put into Fourballer: scores, round details, game settings, results, messages and feedback. You keep whatever rights you have in it. You give us a worldwide, royalty-free, perpetual, irrevocable, transferable licence, with the right to sublicense, to host, store, copy, use, modify, combine, analyse, create works from, publish and distribute your content, and information derived from it (including in de-identified or aggregated form), to run, improve and develop Fourballer and for our other business purposes. Our use of personal information is also described in our Privacy Policy.
Connected services. You agree that we may exchange your information with golf associations, handicap services and clubs (for example the USGA's GHIN system or your club) to provide connected features, such as verifying handicaps, importing data and posting scores, as described in our Privacy Policy. Their own terms and policies apply to what they do with it.
Feedback. If you send us ideas or suggestions, we may use them freely, without any obligation to you.
8. Beta versions
Test versions (for example through TestFlight) are unfinished. They may have bugs, change without notice, or lose data. Don't rely on a beta as your only record.
9. Our service
Fourballer is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose. We may change, suspend or stop any part of the service.
10. Limits on liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for any amount any player owes, pays or fails to pay another. Our total liability for any claim relating to Fourballer is limited to US$10 or the amount you paid us in the past 12 months, whichever is greater. Some states don't allow some of these limits, so they may not all apply to you.
11. Apple
These terms are between you and us, not Apple. Apple isn't responsible for Fourballer or its content, has no obligation to provide support for it, and isn't liable for any claim about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You also agree to Apple's own terms for the App Store and TestFlight.
12. Ending
You can stop using Fourballer and delete your account at any time. We may end or suspend access if you break these terms, or if we stop running the service.
13. Changes
If we make a material change to these terms, we'll tell you in the app before it takes effect. If you keep using Fourballer afterwards, you accept the new terms.
14. Law
These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts for Fairfax County, Virginia, and you and we agree to their jurisdiction, unless the law where you live requires otherwise.
